Terms of Use

These Terms of Use (“Terms”) are an agreement between you (“you” or “user”) and Radio Kenya United LLC, a California limited liability company (“Radio Kenya United”, “we”, “us”). They cover your use of radiokenyaunited.com and our audio streams, podcasts, newsletters, and related features (the “Service”).

By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service for an organization, you confirm you are allowed to accept these Terms for it.

Radio Kenya United is an internet radio and streaming broadcaster for the East African diaspora and for audiences in Kenya, Uganda, and Tanzania. We offer live streams, on-demand podcasts, news and interviews, call-in and community programming, and music. We may change, pause, or stop any part of the Service at any time.

You may use the Service for your own personal, non-commercial listening and taking part, under these Terms.

You may not rebroadcast, retransmit, record for public use, or redistribute our live stream or other content without our prior written permission. Personal, private listening is fine.

You agree not to:

• break any law or infringe anyone’s rights when using the Service;
• copy, record, rebroadcast, resell, or redistribute our streams or content except as these Terms or the law allow;
• post or send content that is unlawful, defamatory, harassing, hateful, obscene, or that invades someone’s privacy or infringes their rights;
• give false information or pretend to be someone else;
• try to disrupt, overload, probe, or gain unauthorized access to the Service or its systems;
• use bots or scrapers except as we expressly allow; or
• use the Service to send spam or to collect others’ personal information without consent.

The Service lets you send us content, for example song requests, messages, call-ins, comments, and testimonies (“User Submissions”).

• You keep ownership. You keep any rights you already hold in your submission.
• You grant us a license. You give Radio Kenya United a non-exclusive, worldwide, royalty-free license to use, broadcast, stream, edit for length and clarity, reproduce, archive, and distribute your submission as part of the Service and its programming, in current and future media.
• You confirm you have the rights. You confirm that you own or may share your submission and that it does not infringe anyone’s rights.
• Consent of others. If your submission features or names another person, you confirm you have that person’s consent, and for a minor, a parent or guardian’s consent.
• We need not use or keep submissions. We may decline, remove, or stop using any submission.

Testimony takedown. If you shared a testimony or call-in and want it taken down, email admin@radiokenyaunited.com. We will stop future use and, where we can, remove it from material we control. Material already broadcast or shared may not be fully recoverable. Our handling of consent and anonymity for sensitive topics is set out in the Privacy Policy.

The Service and its content, including audio programming, text, graphics, logos, and the “Radio Kenya United” name and marks, are owned by Radio Kenya United LLC or its licensors and are protected by law. We give you a limited, personal, revocable, non-transferable license to access and listen for your own non-commercial use. Our podcasts are for personal listening only. You may not use our name, logos, or marks without our prior written permission.

We respect intellectual-property rights and respond to notices of claimed copyright infringement, including under the U.S. Digital Millennium Copyright Act (DMCA).

To report infringing material, email admin@radiokenyaunited.com with the contents the law requires: (1) your physical or electronic signature; (2) the copyrighted work you say is infringed; (3) the material you say is infringing and where it is on the Service; (4) your contact details; (5) a statement that you believe in good faith the use is not authorized; and (6) a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act for the owner.

If your material was removed, you may send a counter-notice to the same address with the same kind of detail, including your consent to the jurisdiction of the federal court for your district (or, if you are outside the U.S., the Central District of California) and your agreement to accept service from the complaining party. We may remove content and end access for users who repeatedly infringe.

Radio Kenya United follows a written Editorial Independence Policy. The owner does not direct or suppress reporting, we disclose coverage of parties we are tied to, and we label paid content. See our Editorial Standards page.

The views of guests, callers, and contributors are their own and are not necessarily ours. To ask for a correction, email admin@radiokenyaunited.com.

Radio Kenya United earns revenue from advertising and sponsorship. We label sponsored or paid content. Mentioning an advertiser or sponsor is not our endorsement of that party’s products, services, or views.

The Service relies on third-party providers, for example our streaming, podcast, payment, and email providers. Your use of features they power may also be subject to their own terms. We are not responsible for third-party services or for sites we link to.

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the Service will be uninterrupted, error-free, or secure. Content on the Service is general information, not professional advice.

To the fullest extent the law allows, Radio Kenya United LLC and its parent, members, managers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service.

You agree to indemnify and hold harmless Radio Kenya United LLC and its parent, members, managers, and affiliates from claims and costs that arise from your use of the Service, your submissions, or your breach of these Terms.

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules.

Before starting any formal proceeding, you agree to first try to resolve the dispute informally by emailing admin@radiokenyaunited.com and allowing 30 days. If it is not resolved, it will be brought only in the state or federal courts in Riverside County, California, and you consent to those courts.

To file a complaint or get more information about this provider, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing, or by telephone at 1-800-952-5210.

We may update these Terms. When we make a material change, we will update the effective date and post the revised Terms. If you keep using the Service after a change takes effect, you accept the revised Terms.
